How many defamation suits have we seen lately against media personalities – Three major, multi-million-dollar suits?
In one suit evidence was allegedly presented showing that the media personality was being paid to defame her target.
And of course the legal cases all revolve around “freedom of speech.”
Because folks in the deep state shout “Free speech!” whenever they’re censored, I’m drawn to continue my comments on the subject. (1)
Accepting payment to defame a person crosses a line in our society because the communications that result from such an agreement cause harm – and are meant to do so.
In the most basic of terms, I believe it’s important to acknowledge that my right and yours to speak freely stops at the point (this is “the line”) where it invites harm on another (period. Full stop).
“Free speech” is not unlimited. To go around shouting “Free speech!” when it’s not an unlimited right – not on any plane of existence – (2) obscures the issue and has to be suspect when criminal behavior is involved.
In my opinion, a mature, democratic society accepts the responsibility of patiently making finer and finer legal distinctions in the area of free speech (or any other human right). They do so in order to retain social cohesion while not steam-rolling over individuals or minorities.
I sat for eight years interpreting refugee law in Canada and every day held the possibility of needing to make finer and finer legal distinctions. It’s humbling.
We’re watching the swamp being drained in real time. Now, those who took the human rights away from so many (as we’re finding out) are shouting loudly that they have rights. We’re being asked to honor the rights of those who violated the rights of others. And because we’re decent people, we will.
But I don’t think the defendants ever counted on being tried in military tribunals, where folks accused of serious human-rights abuses and/or treason are treated as enemy combatants – with no rights.
I don’t think they ever thought they’d face the death penalty.
I don’t think the big reveal will be who killed Kennedy. I think the big reveal will be how many folks have been executed at Gitmo, Guam, Tierra del Fuego, etc., and for what reason.
When we see the total picture, I believe our grief will be the same as losing all our family in a plane crash.
I won’t name names, but I was beyond saddened when I saw the execution lists. I think we’ll have to pass through that trial (and those trials) before we start the upward climb.
